1. Site owner

2. Scope and acceptance
These Terms and Conditions govern access to and use of the Site. By browsing the Site or using its features you declare that you have read and fully accept them. If you do not accept them, please do not use the Site.
3. Nature of the Site: no online sales
The Site is informational and promotional in nature and is aimed primarily at professional operators and businesses. It is not an online shop: products cannot be purchased and contracts cannot be concluded through the Site.
Information on products, services, configurations, availability and any indicative prices does not constitute an offer to the public under article 1336 of the Italian Civil Code, but an invitation to submit a request.
4. Information and quote requests
The forms on the Site (contact, quote request, demo request) are used to send us a request: they do not constitute an order and are not binding on either party. No contractual relationship arises until Exteryo confirms the supply in writing.
The quotations we issue are valid on the terms stated in the quotation itself; the supply of products and services remains governed by the contractual terms agreed between the parties on each occasion, which prevail over these Terms as regards the supply relationship.
You undertake to provide truthful, complete and up-to-date information and not to send unsolicited or automated communications through the forms on the Site, which are protected by anti-spam systems.
5. Technical content and accuracy of information
Datasheets, specifications, dimensions, performance, compatibility, images and availability are published in good faith on the basis of manufacturers' information and may change without notice. Images are for illustrative purposes and may not represent the exact product configuration.
Despite the care taken in preparing them, we do not warrant that the contents of the Site are always complete, up to date or free from errors. Binding specifications are those stated in the quotation or in the contractual documentation.
6. Intellectual property
All content on the Site — text, images, photographs, videos, graphics, layout, trademarks, logos, software, databases and their selection and arrangement — is owned by Exteryo or its licensors and is protected by copyright and industrial property law.
You may consult the Site and reproduce individual items of content for personal or internal use. Save with our written authorisation, any reproduction, distribution, publication, modification or communication to the public of the content is prohibited, as is the systematic extraction or re-utilisation of parts of the database, including by automated means (scraping, mass crawling, text and data mining for commercial purposes).
Third-party trademarks, names and logos appearing on the Site belong to their respective owners and are cited solely to describe and identify the products concerned.
7. Permitted use of the Site
You undertake not to use the Site for unlawful purposes or otherwise contrary to these Terms. In particular, it is prohibited to:
- compromise the security, integrity or availability of the Site and connected systems;
- attempt unauthorised access to restricted areas, accounts or third-party data;
- introduce viruses, malware or harmful code;
- generate abnormal or automated traffic that does not comply with the robots.txt file;
- circumvent or tamper with anti-spam and form protection systems;
- collect personal data or contact details of third parties published on the Site;
- present the content of the Site in a way that is misleading as to its origin.
We reserve the right to suspend or restrict access to the Site in the event of a breach, without prejudice to our right to compensation for damages.
8. Software, applications and demos
The applications and software platforms presented on the Site are licensed under separate agreements. Their presentation on the Site is for information purposes and does not grant any licence, right of use or warranty of operation.
9. Links to third-party sites
The Site may contain links to sites operated by third parties. We have no control over such sites and are not responsible for their content, their personal data practices or their availability.
10. Availability of the Site
The Site is provided "as is" and "as available". While we work to keep it running properly, we do not guarantee continuous, uninterrupted access: the service may be suspended for maintenance, updates, technical reasons or events beyond our control.
11. Limitation of liability
To the maximum extent permitted by law, Exteryo shall not be liable for indirect or consequential damages, loss of data, loss of profit or loss of business opportunities arising from the use or inability to use the Site, or from reliance on the information published on it.
Nothing in these Terms excludes or limits Exteryo's liability for wilful misconduct or gross negligence, for personal injury, or any mandatory rights granted by law, including those of consumers.
12. Personal data and cookies
The processing of personal data collected through the Site is described in the Privacy Policy; the use of cookies and similar technologies is described in the Cookie Policy.
The forms on the Site are protected by Google reCAPTCHA: the Google Privacy Policy and Terms of Service apply.
13. Changes to the Terms
We may amend these Terms at any time, for example to reflect legal developments or new features of the Site. The applicable version is the one published on this page, bearing the last-updated date shown at the top. Continued use of the Site after publication constitutes acceptance of the changes.
14. Governing law and jurisdiction
These Terms are governed by Italian law. The Court of Monza shall have exclusive jurisdiction over any dispute relating to the Site and to these Terms.
If the user is a consumer within the meaning of the Italian Consumer Code, the courts of the user's place of residence or elected domicile remain competent pursuant to article 66-bis of Legislative Decree 206/2005, and the mandatory rights granted to consumers remain unaffected.
15. Language
The English and German versions of this page are courtesy translations. In the event of any discrepancy between versions, the Italian text prevails.
